Please note that we reserve the right to make changes to these Terms & Conditions.  If changes are made, Korvus Group will make a new copy of the Terms & Conditions available on the Website.  We will also update the “Last Updated” date at the top of the Terms & Conditions to reflect the effective date of the change.

 1.Intellectual Property

You agree that Korvus watches, including but not limited to its products, slogan, logo, graphics, user interface, video clips, audio clips, editorial content and software used to implement this website, contains proprietary information and material is solely owned by Korvus Group LLC, and is protected by applicable intellectual property laws, including but not limited to copyright.  You agree that you will not use such proprietary information or materials in any way except for use in accordance with this agreement.  No portion of this website or its proprietary material may be reproduced, in any form or by any means, except as explicitly permitted in these terms & conditions.  You agree to not modify, rent, loan, sell, lease, distribute, or create derivative work based on this website in any manner, and you should not exploit this website in any unauthorized way whatsoever.

 2.Limitation of Liability

To the maximum extent of permitted by law, Korvus Watches and its parent company, Korvus Group LLC exclude all liability for any damages, howsoever arising, including without limitation through contract, including negligence, breach of statutory duty or otherwise arising out of or in connection with your access to or inability to access or use the site and its contents.  All conditions, warranties, and other terms which may be implied by statute, common law or otherwise are hereby excluded to the maximum extent permitted by law.  In no event shall Korvus Watches, its parent company, Korvus Group LLC or their respective directors, officers, contractors, or employees be liable for any indirect, special, or consequential loss or damage, loss of profit, loss of business, loss of contract or loss of data incurred by any user in connection with the Site.  This is to include any sites linked to it and any materials posted on it, even if Korvus watches has previously been advised of the possibility of such damage.  Nothing in these Terms & Conditions shall exclude or limit our liability for death or personal injury arising from our negligence, any breach of the obligations implied by applicable law, or for any fraud, or fraudulent misrepresentation or any other liability to the extent it cannot be waived or limit under applicable law. 

 3.Governing Law and Jurisdiction

These Terms & Conditions shall be governed by, construed and enforced in accordance with the laws of the US State of Texas.  The courts at the registered office of Korvus Group LLC will have exclusive jurisdiction over any claim or any dispute arising from, or related to, a visit to this Site.  Korvus Group LLC reserves the right to bring proceedings against you for breach of these Terms & Conditions in your State of residence or any other relevant State.

 4. Registering Your Account

In order to access certain features of our Website, you will be required to become a Registered User.  A “REGISTERED USER” is a user who creates an account with Korvus by either registering directly with Korvus through the Website or logging into the Website with the user’s social networking account (THIRD PARTY ACCOUNT).  By logging in with your Third-Party Account, you agree that you are entitled to disclose your Third-Party Account login information to Korvus and grant Korvus access to your account, including but not limited to, for use for the purposes described herein, without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account and without obligating Kovus to pay any fees or making Korvus subject to any usage limitations imposed by such third-party service providers.

 5.Payment

All prices are quoted in the denomination stated.   When making a purchase, a valid credit card (Visa, Mastercard, American Express, Discover) is required.  Your payment provider agreement governs your use of the designated credit card, and you must refer to that agreement and not the Terms & Conditions to determine your rights and liabilities.  By providing Korvus Watches with your credit card number and associated payment information, you hereby authorize Korvus Watches to immediately charge your credit card for all fees and charges due and payable to Korvus Watches or credit your credit card for any refunds owed and that no additional notice or consent is required.  You agree to promptly notify Korvus Watches of any change in your billing address or the credit card used for payment.  Korvus Group reserves the right to make changes to its prices and billing methods.

 6.Third Party Payment Services Provider

The Website is hosted by Shopify.  If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data.  The payment gateway is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).  Your purchase transaction data is stored only as long as is necessary to complete transaction.  Once the transaction is complete, your payment data is then deleted.  All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.  PCI-DSS requirements help ensure the secure handling of credit card information by our Site and its service providers.

 7.Order and Acceptance

Each part of an order that you submit constitutes an offer to purchase merchandise.  If you have placed your order through the website, you will receive an email from Korvus confirming receipt of your order, usually within minutes.  If you do not receive an email from Korvus confirming receipt of your order, please contact Korvus customer service at support@korvuswatches.com before you attempt to place another order.  Please note that Korvus’ confirmation of receipt of your order does not equate to the acceptance of your order.  Korvus is not deemed to have accepted any part of your order until the requested merchandise has been shipped out and a shipment confirmation email has been sent to you.

 8.Order Cancellation

Korvus reserves the right to cancel any order to include but not limited to unavailability of merchandise, error pertaining to price or description of merchandise.  If Korvus cancels your order, we will contact you to inform you of the cancellation.

 9.Changes to Terms & Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms & Conditions at any time.  If this content is revised or replaced, the change will go into effect immediately and the “Last Updated” date will change to reflect the effective date of the change.  What constitutes a material change will be determined at our sole discretion.
